Alina Habba has stepped down as the US Attorney for New Jersey. This comes after a legal ruling that questioned her eligibility to serve.

Acceptance of Resignation

The head of the Justice Department, Pam Bondi, confirmed her stepping down on Monday. In a statement that the appeals court finding made it impossible for her to effectively run her office.

"But do not mistake compliance for surrender," she wrote. "My fight will now extend throughout the country."

Legal Background

Her resignation follows closely on a US appeals court ruled that she had been serving in violation of the law as the federal prosecutor. This ruling is expected to impact scores of criminal cases in the state.

The judicial panel said that a temporary posting that did not receive Senate approval ran afoul of the federal law governing appointments.

Future Role and Reaction

Bondi said that the former prosecutor will continue working within the justice department as a high-level advisor. Habba plans to seek further review of the court's action, with hopes of a reversal.

On a social media platform, Bondi wrote that the court "should not be able to second-guess the appointment of attorneys tasked with performing the primary duty of the administration of criminal prosecution."

Accomplishments Cited

Bondi praised her tenure and said that under her leadership, the state capital of Newark saw a significant drop in criminal activity. Additionally that the southern city of Camden experienced its first summer in 50 years free from homicides.

Prior to assuming the top New Jersey post, Trump had stated he was naming her as his senior adviser in a potential future term, labeling Habba as deeply loyal and a relentless legal advocate.
